Article 1. The Commission Against Corruption created by
means of Executive Decree No. 107-A, published in Official Gazette
No. 19 dated 10th. of March 1997, will continue operating until
the 10th. of August of 1998.
Article 2. AUTHORITY. The Commission Against Corruption will
have the following powers:
a) Receive, know and investigate as a public office or under request
of the interested party, the corruption accusations that are submitted
and/or any other one that should be known by any way;
b) Oversee actions to prevent acts of corruption and to promote
the application of the corresponding sanctions before the competent
authorities;
c) Send management results to the competent organizations, according
to the applicable legal procedures so that corresponding legal actions
start and establish administrative liabilities, either civil or
criminal ones;
d) Request, according to the Law, reports that are deemed necessary,
to any public or private institution, in order to know in a timely
and detailed manner the actions that have been accomplished with
respect to the accusations and reports sent by the Commission;
e) Coordinate with the Prosecutor the corresponding investigation
actions;
f) Request, according to the law, the criminalization of the corruption
of public officials, as stated in Article 33 of the Law of Modernization
of the State;
g) Request competent Judges provisions on measures related to the
phenomenon of corruption, actual or personal, pursuant to the Law;
h) Coordinate, according to the Law, with the respective Superintendence
and with the Public Ministry, the information obtained and protected
with secrecy; and, i) Request records, files, reports and other
necessary evidence for the investigation process to any public office,
according to the Law;
Article 3. Composition and other powers of the Commission
Against Corruption are given by Executive decree No. 107-A published
in the Official Gazzete No. 19 dated 10th of March, 1997, as well
as by this Decree and by internal procedures that are dictated by
mentioned Commission to the effect.
Article 4. The Minister of Finances and Public Credit will
accomplish the budgetary reforms that would be necessary for funding
the Commission.
Article 5. The present Decree will entry in force on the
date of the promulgation of this instrument in the Official Gazzete.
